1. Protocol Agreement

By accessing the site, creating an account, or finalizing a checkout sequence, you accept and agree to be bound legally by these Terms. If you do not agree to these terms, you are strictly prohibited from using our platform and purchasing our gear.

2. Eligibility & Accounts

To purchase items or establish an account on this platform, you must be at least 18 years of age or the age of majority in your jurisdiction. You are entirely responsible for maintaining the strict confidentiality of your account credentials, passwords, and for restricting unauthorized access to your device. Formula 41 Labs reserves the complete right to refuse service, terminate accounts, or cancel orders at our sole discretion.

3. Order Execution

All orders placed through our automated checkout pipeline represent an offer to purchase. We reserve the right to accept, modify, or decline any order for any reason, including product availability, pricing discrepancies, or suspected fraudulent activity. If an order is flagged by our risk assessment protocols, we may require additional verification before authorization.

Because our platform utilizes high-speed automated pipelines connected directly to our third-party logistics (3PL) fulfillment centers, orders cannot be cancelled, modified, or rerouted once submitted. If an error was made during checkout, the customer must wait for delivery and execute a standard return sequence.

4. Payment Terms

All prices displayed on the platform are in U.S. Dollars (USD) and exclude applicable state taxes and shipping fees, which are calculated at checkout. We accept authorized credit cards, debit cards, and specified digital payment gateways. By submitting payment coordinates, you authorize Formula 41 Labs to charge the designated amount. In the event of an unjustified chargeback or payment dispute initiated by the customer, we reserve the right to suspend account access and pursue legal remediation.

5. Shipping Logistics

Formula 41 Labs executes domestic fulfillment exclusively from third-party logistics warehouses located within the United States. We do not engage in dropshipping. Standard shipping is free for orders exceeding $50 or for specific system bundles; otherwise, a flat-rate shipping fee of $6.95 is applied.

Title and risk of loss pass completely to the customer upon delivery of the merchandise to our designated shipping carrier. We are not responsible for delivery failures, delays, or lost packages resulting from incorrectly entered shipping addresses by the customer, or actions taken by the postal carrier.

6. Subscription Terms

If you elect to enroll in our recurring subscription program, you authorize Formula 41 Labs to execute automated, recurring charges against your saved payment method at the designated monthly interval (every 30 days). Subscription prices are subject to change, with prior electronic notice. You retain absolute control over your subscription and may pause, modify, or cancel your enrollment up to 48 hours before the next scheduled billing cycle via your customer portal.

7. Returns & Guarantees

Purchases are backed by our 30-Day Performance Guarantee as outlined in our official Returns Policy. Refund requests must be initiated within 30 days of confirmed delivery. Returns are evaluated and processed only upon the physical return of the containers (whether full, partially used, or empty) to our domestic fulfillment facility. Return shipping and logistics costs are borne entirely by the customer. Original flat-rate shipping fees ($6.95) are non-refundable.

8. Health Disclaimer

Our Performance Fuel dietary supplements and Skin Arsenal products contain potent, active ingredients. The statements made regarding our dietary supplements have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

Individual biological results will vary based on body chemistry. It is the customer's strict responsibility to read all ingredient disclosures, allergens, and instructions before application. 9. Intellectual Property

All content hosted on this platform—including text, graphics, editorial photography, brand names, product designs, proprietary formulas, code, and logos—is the exclusive intellectual property of Formula 41 Labs. Any unauthorized reproduction, modification, distribution, or commercial exploitation of our assets without explicit written consent is strictly prohibited and will result in legal action.

10. Liability Limitations

To the maximum extent permitted by applicable law, Formula 41 Labs, its directors, employees, and logistics partners shall not be liable for any indirect, incidental, punitive, special, or consequential damages resulting from the use of, or inability to use, our products or platform. Our total liability to you for any validated claim arising from these terms shall not exceed the actual dollar amount paid by you to the company for the specific product in question.

11. Governing Law

These Terms of Service and any distinct agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal action, dispute, or proceeding arising under these terms shall be brought exclusively in the federal or state courts of competent jurisdiction where the company is legally registered.
